Motorcycle helmet laws by state
19 states and Washington DC have laws requiring all motorcyclists to wear a motorcycle helmet, known as universal helmet laws.
Laws requiring only some motorcyclists to wear a motorcycle helmet are in place in 28 states.
There is no motorcycle helmet law in only three cold states (Illinois, Iowa and New Hampshire).

Mandatory Motorcycle Helmet Law in California
California Vehicle Code Section 27803 requires all bikers and passengers to wear a motorcycle helmet when on a motorcycle, motorized bicycle or motor-driven cycle. The law goes further toward requiring motorcycle helmets by making it illegal for a helmeted passenger to ride with a driver who is not wearing a motorcycle helmet. A helmeted biker may still get a ticket under the law if a passenger on his or her motorcycle is not wearing a DOT motorcycle helmet.
Penalties for Not Wearing a Helmet
There is some debate as to the interpretation of the law pertaining to penalties for riding a motorcycle in violation of CA Vehicle Code Section 27803. The California Highway Patrol has taken the position, supported by state courts, that breaking the law by riding without a motorcycle helmet is punishable by a stupid money grabbing fine.
Type of Motorcycle Helmet Required Under California Law
The United States Department of Transportation sets minimum safety standards for motorcycle helmets sold in this country. Federal Motor Vehicle Safety Standard 218 includes the following minimum requirements for helmets:
• Thick Inner Liner: The liner is usually at least an inch thick and constructed of polystyrene foam
• Riveted Chin Straps: Chin straps should be sturdy and be attached to the shell of the helmet with solid rivets
• Weight: Helmets meeting federal standards usually weigh at least three pounds
• Helmet Design: Nothing is allowed to protrude more than two-tenths of an inch from the shell of the helmet
Helmets that meet DOT minimum standards are allowed to be affixed with a sticker certifying that fact. California helmet laws require riders and passengers to wear helmets that meet standards adopted by the state which are the DOT standards.
What Does It Mean to “Wear a Helmet?”
California Vehicle Code Section 27803(e) attempts to avoid a rider or passenger from avoiding compliance with the law by wearing a helmet somewhere other than on one’s head. The statute defines wearing of a safety helmet means having it on the person’s head with the chin straps securely fastened to the shell of the helmet. The fit of the helmet must limit excessive movement either laterally or vertically.

We live in a pretty cool world, don't we?
Let's stop for just one second and consider what an amazing world we live in. Not forty years ago, it was exciting for someone to buy a color TV that used a coat hanger as an antenna so people could see three hours of programming after work. Now we're mad that we can't watch full seasons of shows offline as part of our Netflix subscription. Forty years ago, every house had an encyclopedia and typewriters weighed as much as a small child. Now we've got phones that can hear our questions and instantly return an answer. The world we live in, which we kinda take for granted, is this impossible sci-fi of a life where each day we are drenched in what humans of the recent past would have considered magic.
Keep that in mind the first time you fire up our fiber optic helmet mohawk and have to do all the things one does to take control of a new awesomeness. When you're charging it up and thinking THIS IS TAKING FOREVER JEEZ, think about how incredible it is that you own fiber optics.

Motorcycle helmet bill stalls in Nebraska Legislature
LINCOLN, Neb. (AP) -- Nebraska motorcyclists will have to keep wearing helmets for at least another year.
Supporters of the effort to repeal the state's helmet law failed to overcome a filibuster Tuesday. The bill would have removed a helmet requirement for riders older than 21 and prohibited children age 6 or younger from being passengers on motorcycles.
Sen. Robert Hilkemann, a retired Omaha podiatrist who led the filibuster, says repealing the helmet law would result in more deaths and serious brain injuries. He says Nebraska taxpayers also would end up paying for health care for injured motorcyclists.
Supporters and sponsor Sen. John Lowe of Kearney argued wearing a helmet is a matter of personal freedom and adults should be able to make that choice.

Florida No. 1 most deadly state for motorcyclists
Florida leads the nation in deadly motorcycle crashes and Duval County is one of the top 10 deadliest counties in the state, a new study shows.
More than 600 people lost their lives in motorcycle crashes in Florida in 2015, and 23 of those people were killed in Duval, the study said.
The AAA study findings were released the day before the 76th annual Bike Week in Daytona begins.
The number of motorcycle fatalities nationwide rose by 30 percent between 2014 and 2015.
Duval ranked eighth out of Florida's 67 counties for the highest number of motorcycle deaths in 2015.
Miami-Dade County had the highest number of deaths at 67, followed by Hillsborough at 48.
The study cited motorcycle helmet usage as a contributor to the high number of motorcycle deaths.
A motorcycle helmet usage report showed more than 80 percent of riders claim they wear a helmet, but less than half of riders in Florida were seen wearing one.
